1. Introduction

These Terms and Conditions govern your access to and use of the Myschool Portal, including the Administration Portal, Lecturer Portal, and Student Portal (collectively, the "Platform"), provided by TravelTube. By accessing or using the Platform, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you may not access or use the Platform.

2. Use of the Platform

2.1. Eligibility: You must be at least 13 years old to use the Platform.

2.2. Account Creation: You are responsible for maintaining the confidentiality of your account information and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

2.3. Prohibited Conduct: You agree not to:

* Use the Platform for any unlawful purpose or in any manner inconsistent with these Terms and Conditions.

* Use the Platform to transmit any viruses, worms, defects, or other items of a destructive nature.

* Interfere with or disrupt the integrity or performance of the Platform.

* Impersonate any person or entity, or falsely claim an affiliation with any person or entity.

* Collect or use any personal information about other users without their consent.

* Use the Platform to engage in any form of harassment, abuse, or discrimination.

* Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

* Use the Platform to advertise or solicit, except as expressly permitted by TravelTube.

3. Intellectual Property

3.1 Ownership of Content: * School Content: Schools retain ownership of all content they upload to the Platform, including but not limited to course materials, assignments, assessments, and any other materials related to their educational programs.

* Student Content: Students retain ownership of their original work (e.g., essays, assignments, projects) uploaded to the Platform. However, by uploading such content, they grant Myschool a non-exclusive, royalty-free, worldwide, transferable, sub-licensable, irrevocable, perpetual license to use, reproduce, distribute, prepare derivative works of, display, and perform such content in connection with the operation and provision of the Myschool Portal.

3.2 Myschool's Rights:

* Myschool reserves the right to use, reproduce, and display aggregated and anonymized data derived from user content (including student work) for the purpose of improving the Platform, conducting research, and generating educational insights.

* Myschool reserves the right to remove any content from the Platform that violates these Terms and Conditions, infringes on third-party rights, or is otherwise deemed inappropriate or objectionable by Myschool in its sole discretion.

3.3 Copyright and Intellectual Property:

* You agree that you will not upload any content to the Platform that infringes upon the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party. * You are solely responsible for ensuring that any content you upload to the Platform does not violate the intellectual property rights of others.

* Myschool assumes no liability for any infringement of intellectual property rights arising from the use of the Platform or the content uploaded by users.

4. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRAVELTUBE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

5. Limitation of Liability

IN NO EVENT SHALL TRAVELTUBE BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE PLATFORM, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF TRAVELTUBE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Indemnification

You agree to indemnify and hold harmless TravelTube, its affiliates, officers, directors, employees, agents, and licensors from any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of or in any way connected with your use of the Platform or your violation of these Terms and Conditions.

7. Third-Party Links

The Platform may contain links to third-party websites. These links are provided for your convenience only and do not signify an endorsement by TravelTube of such websites. TravelTube is not responsible for the content of any linked website.

8. Changes to Terms and Conditions

TravelTube reserves the right to modify these Terms and Conditions at any time without prior notice. You are responsible for reviewing these Terms and Conditions periodically for any changes. Your continued use of the Platform following the posting of any changes to these Terms and Conditions constitutes your acceptance of those changes.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Estonia.

10. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and TravelTube with respect to your use of the Platform and supersede all prior or contemporaneous communications, representations, and understandings, whether oral or written.

11. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

12. Waiver

The waiver by TravelTube of any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision on any other occasion.

14. User Data

TravelTube reserves the right to collect and use user data for the purpose of improving the Platform, providing personalized experiences, and for marketing purposes.

15. Advertising

TravelTube reserves the right to display advertisements on the Student Platform, including but not limited to:

* Social Media: Within the social media features of the Platform.

* Marketplace: Within the marketplace section of the Platform.

* Games: Within the games section of the Platform.

* Accommodation: Within the accommodation section of the Platform.

* Dopamine Menu: Within the dopamine menu section of the Platform.

* Scholarship: Within the scholarship section of the Platform.

* Any other section added in the future.

16. Disclaimer of Liability for User Interactions

TravelTube is not responsible for any liability arising from interactions between users on the Platform, at any level (Administration, Lecturer, or Student). This includes, but is not limited to, disputes, disagreements, or any harm caused by other users.

17. Ownership of User Data

TravelTube owns all rights, title, and interest in and to all data generated by the use of the Platform, including user data, usage data, and any other data collected by TravelTube.

18. Termination

TravelTube may terminate your access to and use of the Platform at any time, without prior notice, for any reason whatsoever.

19. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Estonia.

24. Payment and Billing

24.1 Subscription Fees:

* Schools must subscribe to the Myschool Portal to access the Platform.

* Subscription fees are payable monthly or annually in advance.

* Payment options may include credit card, bank transfer, or mobile money.

24.2 Billing:

* Invoices will be issued monthly or annually to the designated billing contact at the school. * Payment is due within 17 days of the invoice date.

* Late payments may be subject to late payment fees.

24.3 Price Changes:

* TravelTube reserves the right to adjust subscription fees at any time upon 30 days written notice to the school.

24.4 Cancellation:

* Schools may cancel their subscription at any time by providing 30 days written notice to TravelTube.

* Cancellation will be effective at the end of the current billing cycle.

* No refunds will be issued for unused portions of the subscription period.

24.5 Payment Disputes:

* Any disputes regarding payment must be submitted to TravelTube in writing within 7 days of the invoice date.
